to the bench?

days, so if you fall in love with Emma or Jacob, don’t let
fears of popularity force you to use another name you don’t

An employee of Ridings High School, Miss Miller, claimed unfair dismissal after retiring on grounds of ill health. The Employment Appeal Tribunal (EAT) decided that in Miss Miller’s case the claim does not hold, since the termination of employment came about by mutual consent.

An employee can only claim unfair dismissal in three cases: If the employee has been dismissed; if they have come to the end of a fixed contract; or if the employee has resigned in response to some action on the part of the employer.

There has been a spurt in cases where employees who have taken ill health retirement later bring claims against their employers. The Miller vs. Governing Body of Ridings High School case deals with such a circumstance.

The EAT’s ruling has provided some comfort to employers on this front. It has upheld the Tribunal’s decision that retirement on ill health grounds is equivalent to termination by mutual consent. Thus, such an employee does not fall into the previously stated three categories and the employee is not qualified to bring a claim of unfair dismissal in this situation.

While the EAT’s decision is certainly a welcome one for employers, they should be careful in such cases, particularly since

• if the situation can be shown as a forced resignation, the employee’s claim will be valid;
• the claim may still be made if the employee can prove discrimination against disability, particularly from failure to make adjustments (though, in Miss Miller’s case, she failed in this claim)
• Moreover, the ill health retirement documentation should be carefully prepared so that it makes clear that the retirement has been agreed upon by both parties and is not being forced upon the employee.

Electric in Europe — and there are thousands — you have a slim
chance of finding that person without more detailed information like his or her name or the city where he or she lives.

The major drawback of OpenBC is that while a user can upload a large group of email addresses and invite those email addresses to link with him, there is no facility for otherwise sending invitations to more than one user at a time. The creators of OpenBC explain this as a requirement to prevent spamming. However, for someone who wants to develop ties to Poland and invite Polish users to join his network, it is exceedingly tedious to invite people one-by-one with a message for
each recipient.

Similarly, if you wanted to invite people who work for Volkswagon, you would have to invite them one by one into your network. After several hours, I gave up with the tedium.

A second drawback of OpenBC is that it has not yet achieved widespread appeal. I looked for people working at the Swiss mutual fund called Unifund SA.
